But the privilege is anything but simple when applied to corporate entities. Varying jurisdictional standards, subsidiaries and affiliates, Upjohn warnings, consultants, and waiver are just a few of the privilege issues that arise when employees communicate with corporate attorneys. And courts apply a higher privilege standard to in-house lawyers’ communications with corporate representatives. This presentation discusses the privilege challenges and pitfalls facing outside and in-house lawyers on a daily basis.
